Mobile home park residents get evictions dismissed
Several Regency mobile home park residents who went to court Thursday to contest eviction notices can breathe a sigh of relief, at least for now. Magistrate Karen Egerton dismissed several of the cases on the grounds that Regency had not properly served the tenants with the necessary paperwork. Regency officials issued at least 18 evictions in July, citing nonpayment of rent. Some were later put on hold at the request of the Iowa attorney general's office. The Johnson County Sheriff's Department has launched a criminal investigation into poor living conditions and questionable business practices at Regency, and the Consumer Protection Division of the attorney general's office is also conducting a civil investigation of possible consumer fraud. Egerton said the eviction notice must either be sent by certified registered mail or personally delivered. If it is personally delivered, the person receiving the notice has to sign an acknowledgment of receipt. Regency can re-file the evictions that were dismissed. Marc and Barbara Johnson were among those who received an eviction notice, although Barbara Johnson said they are up to date on rent and taxes. Johnson brought her title and receipts to the courthouse as evidence. She said managers recently told her she needed to pay back rent on the property from a previous owner. "We bought the trailer from somebody who owed back rent," Johnson said.
