Stalemate at Exit 5: Planning Board won’t support Home Depot zoning change – yet
Planning Board members are not ready to support a Town Meeting article proposing to rezone 48 acres off Home Depot Road from “rural residential” to “highway commercial.”

Board members and attorney Ed Angley, representing property owner Viking Development, failed to reach consensus on the terms of a draft memorandum of understanding between the town and the developer for roadway improvements and other site issues limiting development.

The door isn’t closed, however, on support for the article. Chairman Marc Garrett said the board needs more time to review the draft memorandum as reviewed by town counsel. There was also a second draft on the table during the special continued public hearing the day after Patriots Day.
“We’re not slamming the door on this,” Garrett said.

Board members said they generally support the concept of roadway improvements and the change to highway commercial but have several questions left unanswered, including the impact of a Long Pond Road corridor study being undertaken by the town, the results of which are expected next month.

“This isn’t ready for primetime,” Planning Board member Larry Rosenblum said.

Rosenblum said he wants to see the results of the study, since build-out potential along Long Pond Road is his greatest concern. He said he might be able to support the zoning change after taking the results of the study into consideration.
“This is exactly what planning requires that we do,” he said.

Planning Board members and town counsel proposed several changes to the memorandum of understanding, but Angley said he could not agree to some of those changes without the consent of his client, Viking President David Gilvar, who was not present Tuesday night. He also said he only received the updates to the draft memorandum less than an hour before Tuesday night’s hearing.

Angley, whose name appears on the petition placing the zoning change on the April 4 Town Meeting warrant, said an agreement must be in place for the article to go forward.

“If we don’t have a signed memorandum of understanding by Town Meeting, I’ll withdraw the article,” he said.

If the zoning change doesn’t go forward or isn’t approved at Town Meeting, Angley said, Viking Development would likely sell the property. If it does pass, he said it could take four or five years given the state of the economy for any kind of development of the 48 acres.

Viking Development proposes to commit at least $1 million in traffic improvements at Home Depot Drive east to Obery Street. Among the proposed changes are the widening of Home Depot Drive and addition of a second left turn lane. The right turn lane would become a right turn-only lane. The Exit 3 southbound off-ramp would be widened and a second right turn lane added.

Angley said he could not commit to language proposing that Viking pay for the town’s legal and consulting fees, requiring a performance bond, preventing earth removal for development in the town’s Zone 2 aquifer protection zone, or limiting future uses of the site when future uses are not known. He did agree to have work start at the standard 7 a.m. as opposed to 6 a.m. as written in his proposal and to a slope stabilization plan.

Reading from a list of Planning Board Malcolm MacGregor’s concerns, Garrett said water resource protection is an issue with the town planning to put the Long Pond Road wellhead on line and the potential for a second wellhead in Zone 2.
